Dow Gut-checked At Open

The National Association of Realtors reports sales of existing single-family home rose 1% to an annualized rate of 4.87 million units in December, below the Street’s expectation for 4.94 million units.

The Dow had fallen 140 points before 10:00 A.M. ET, or 0.86 percent, after a report showed U.S. factory growth skidded to the lowest level since October and corporate heavyweights revealed mixed quarterly earnings. The broader S&P 500 is down 0.7%, with every major sector in the red.

The number of Americans filing for first-time weekly jobless claims rose last week to 326,000 from a downwardly revised 325,000. Wall Street expected the number of claims to hold steady at 326,000.

Former high-ranking EPA official John Beale, who recently was sentenced to prison for fraud, told Congress last month that he was working on a “project” that aims to “modify the DNA of the capitalist system.”

The comment appears in recently released transcripts of the John Beale deposition before the House Oversight and Government Reform Committee, which can be viewed below the article. The Institute for Energy Research, who is a frequent critic of the Obama energy policy, said the claim is a “smoking gun” that reveals the administration’s true intentions.

PeoplesPunditDaily.com reported in October that an EPA power grab will grant “unprecedented power over private property across the nation,” which comports with the picture painted in the Beale deposition.

Beale was sentenced last month to 32 months in prison for bilking taxpayers out of nearly $1 million by pretending to be a CIA agent. However, in the transcripts, he offered detailed testimony about meetings he allegedly participated in with EPA Administrator Gina McCarthy, when she was the head of the Office of Air and Radiation.

Beale claimed the two officials started meeting in mid-2009, and at one such meeting his “fabricated story about working at CIA came up.” Beale recollected a conversation in which he began telling her about a “project” he wanted to work on, which he characterized as “green economics.”

Perhaps most concerning, Beale found the most successful economic system, one that boasts the most people being raised out of poverty in the history of economics, to be an obstruction to EPA mission creep. He revealed that he believed environmental regulations were reaching their “limits,” because “the fundamental dynamic of the capitalistic system is for businesses and individuals to try to externalize all costs.”

Thus, he was compelled to complete the EPA mission creep project, he said he began working on his plan, a plan that involved “coming up with specific proposals that could be — could have been proposed either legislatively or things which could have been done administratively to kind of modify the DNA of the capitalist system.”

Beale, in his infinite arrogance and boldness, said this “is not new” and has occurred “tens of times” in the history of capitalism.

“It’s not a God-given system that was created once and never changes. It changes all the time,” he said. In a bombshell revelation, he testified that EPA administrator Gina McCarthy was aware of the project and “we met frequently to talk about it and had actually quite deep discussions.” He said, though, that the project was eventually “scrapped.”

In a revelation that may not be at all surprising to conservatives, Beale also claimed the so-called “project” actually commenced under the George W. Bush administration.

The Institute for Energy Research pounced on the comments in the Beale deposition, citing these and other statements as proof that the administration is, in fact, pursuing a power grab.

“This is the smoking gun. For years, we have been saying the real agenda behind this administration’s energy and environmental policies is the just what President Obama has said it is: to fundamentally transform America,” Senior Vice President Dan Kish said in a statement.

“In his testimony under oath, Beale, perhaps unwittingly, has laid bare the administration’s end goal. The President’s policies are not about carbon, they are not about coal, they are not even about energy and the environment. … These policies are not about energy, but power.”

Rep. Elijah Cummings (D-MD), top Democrat on the committee, said Beale “spun an elaborate web of lies” to fool his EPA supervisors, but ignored the EPA mission creep to change the structure of the American economy into what the UN chief called the most conducive economic system to green policy implementation — socialism — or, more particularly, China.

But then again, while releasing the 263 pages of documents (below), neither did the leaders of the House Oversight and Government Reform Committee, who would not comment on that section of the transcript. They, too, pretended the real story was the instance of fraud committed by Beale, by lying about working for the CIA.

“This is an egregious example of fraud on the highest levels of management at the EPA,” Rep. Darrell Issa (R-CA), chairman of the committee, said.

The EPA has not responded to a request for comment.

A 1,500-year-old Byzantine church boasting intricate mosaic decor was uncovered by archaeologists in southern Israel.

The Israel Antiquities Authority (IAA) said the Byzantine-era structure “probably served as a center of Christian worship for neighboring communities.”

The discovery was made during a routine salvage excavation conducted by the IAA prior to the construction of a new neighborhood in the area.

In total, the newly discovered building is roughly 72 feet long and 40 feet wide, complete with a central hall and two side aisles that are divided by marble pillars. The courtyard, which is located at the front of the structure, was constructed with a white mosaic floor and a cistern.

In the immediate vicinity of the courtyard they found a rectangular hall with another, even more intricate mosaic floor with colored geometric designs.

Including among the finds are 5 inscriptions, one of which mentions Mary, mother of Jesus, and Jesus Christ, himself.

“At its center, opposite the entrance to the main hall, is a twelve-row dedicatory inscription in Greek containing the names Mary and Jesus, and the name of the person who funded the mosaic’s construction,” archaeologist Daniel Varga said in a press release.

The main hall has a mosaic with depictions of a variety of animals including zebra, leopard, turtle and wild boar; all of which, are included among Christian symbols.

Among the 1500-year-old church itself, archaeologists also discovered glass vessels, oil lamps, amphorae, cooking pots, kraters, and bowls. These finds “indicate a rich and flourishing local culture” during the Byzantine period.

In order to preserve the site, it will be covered with dirt and the IAA is making plans to remove the mosaic floors to be put on display.

The Democratic Party has bet their midterm fortunes on a rather ironic message of income inequality, which the president said is the defining challenge of our time. But a new survey (view embed below) finds that bet may have been foolishly placed on a bad tip.

A new Fox New poll found that only 13 percent of registered voters say the government shouldn’t interfere with the fact some citizens make more than other citizens.  A rather surprising 62-percent majority said it is okay to have income inequality “because that’s just how the economy works,”  and though 21 percent said income inequality “stinks,” they still say the government “shouldn’t get involved.”

And the sentiment is observable across the class spectrum, which in and of itself, is an anti-American classification. Only 21 percent of voters who have an annual household income below $30,000 say the government should target income inequality, while even fewer — 12 percent — of those with incomes at or above $100,000 agree.

The Democrats and, in fact, the official platform of the Democratic Party, tends to view the economy as  a zero-sum game, with successful Americans necessarily benefiting from the suffering of others. But Americans do not agree. Only 12 percent of registered voters said if someone makes a lot of money it means someone else has to make less, while a whopping 84 percent said the economy isn’t a zero-sum game.

Again, the sentiment cuts across all demographics of income, with an overwhelming 83 percent of registered voters with incomes below $50,000 in agreement, compared to a nearly identical 84 percent with incomes at or above $50,000.

In traditional American fashion, a majority of registered voters think government involvement can make income inequality worse, a possible reflection of the reality under collectivist ideologue, President Obama. Under the Obama administration, poverty and dependence have both skyrocketed, even as the top wealthy 1 percent have accumulated 95 percent of the wealth.

According to the survey conducted for Fox News, 55 percent think giving unemployment benefits to people who have been out of work for a long time discourages them from looking for a job.  Even though Americans are compassionate in their past support of the long-term unemployed, both higher and lower-income groups say long-term jobless benefits incentivize Americans to stop trying to find work.

On the actual duration of time the federal government should be offering unemployment benefits? A significant quarter, or 26 percent, say jobless benefits should be offered for less than 1 year, 36 percent said for 1 year, 13 percent said 1.5 years, and 20 percent (1 in 5) said 2 years or more.

The Fox poll isn’t all bad news for the Democrats, as a 56-percent majority said they agee with the president and Democrats the minimum wage should be raised, but 1 in 4 registered voters wouldn’t raise it (25 percent) and 15 percent said the government shouldn’t ever be telling businesses what to pay their employees. Taken together, it’s a significant minority who take a hands off approach. A clear consensus among economic experts holds all data show raising the minimum wage costs the economy more jobs, a fact echoed by he Department of Labor.

A study conducted by the Department of Labor concluded that the first minimum wage, 25 cents per hour in 1938, cost the jobs of 30,000 to 50,000 of the 300,000 workers who were covered and had previously earned below the minimum. And a 2007 review of 102 studies that were conducted beginning in the 1990s by David Neumark and William Wascher found, “Indeed, the preponderance of the evidence points to disemployment effects.”

Demographic groups who are most likely to support raising the minimum wage include blacks (83 percent), Democrats (76 percent), liberals (75 percent), voters whose income is below $30,000 (67 percent) and women voters (63 percent).

Ironically, among the individual issues survey in the new Fox poll, the 39 percent approval Obama gets for the job he’s doing on income inequality (39 approve), is the highest rating he gets. In fact, the president’s job approval is stubbornly stuck in the low 40s in both the Fox poll and the PPD average job approval ratings. However, Americans aren’t concerned with income inequality, with just 12 percent viewing income inequality as the top economic issue facing America. What Americans do care about is jobs and unemployment (40 percent), along with government spending (36 percent).

The Fox News poll is based on landline and cell phone interviews with 1,010 randomly chosen registered voters nationwide and was conducted under the joint direction of Anderson Robbins Research (D) and Shaw & Company Research (R) from January 19-21, 2014.  The full poll has a margin of sampling error of plus or minus three percentage points.

At last estimate, around 300,000 attended the Roe v. Wade anniversary march in Washington D.C. to mark 41 years since the Supreme Court decision. And they did so with the blessing of Pope Francis from the Vatican, and the stanch opposition of President Obama.

The annual “March for Life” is held every January on the Roe v. Wade anniversary, when the Supreme Court’s 1973 decision to proclaim a constitutional right to abortion. The Roe v Wade anniversary drew many Catholic high school and college students from all across the nation to peaceful protest, hold events, and lead prayer vigils that led up to a rally and march on the National Mall.

President Obama said the 41st anniversary of the Supreme Court’s Roe v. Wade decision is a chance to “recommit ourselves to the decision’s guiding principle: that every woman should be able to make her own choices about her body and her health.”

Then, rather than addressing the 55 million babies who have been terminated as a result of a nation’s failing at personal choice, he took the opportunity to push his failing health care law, ObamaCare.

It was a stark contrast from Pope Francis, who tweeted out support for the movement, and a plea for all to wake up to the moral failings of abortion.

That certainly was of no concern to President Obama, but House Majority Leader Eric Cantor (R-VA) said during his speech there had been an expansion of abortion coverage in the nation’s health care overhaul. It is true that under ObamaCare, federal funding for abortion is now a reality on a scale never-before comprehended up to just a few years ago.

Now, particularly due to the services provided under Medicaid expansion, the number of aborted babies, by most estimates, will rise at an accelerated rate due to the abortion rates among poorer Americans.

S&P lawsuit

Harold McGraw, the chairman of McGraw-Hill Financial Inc (MHFI.N), alleged in a declaration filed in the S&P lawsuit on Monday, former U.S. Treasury Secretary Timothy Geithner threatened retaliation for its decision to downgrade the U.S. credit rating during the 2011 debt ceiling debate.

The allegation was made as S&P defends itself against the government’s $5 billion fraud lawsuit surrounding rating practices leading up to the 2008 financial crisis.

McGraw said he returned a call from Geithner on August 8, 2011, three days after S&P cut the U.S. credit rating to “AA-plus,” and that Geithner told him “you are accountable” for an alleged “huge error” in S&P’s work.

“He said that ‘you have done an enormous disservice to yourselves and to your country,'” and that S&P would be “looked at very carefully,” McGraw said. “Such behavior could not occur, he said, without a response from the government.”

McGraw said he learned of Geithner’s concerns from a message left by one of the Secretaries former underlings at the Federal Reserve Bank of New York, where Geithner served as president in 2008.

The U.S. Department of Justice, which filed the S&P lawsuit U.S. v. McGraw-Hill Cos et al, accused S&P of hurting banks and credit unions by inflating ratings to win more fees from issuers, and then failing to downgrade debt backed by deteriorating mortgage-backed securities fast enough.

S&P has claimed that the lawsuit was filed in retaliation for the downgrade, and should be dismissed. Its main rating agency rivals, Moody’s Investors Service and Fitch Ratings, were not sued.

U.S. officials have said there was no connection between the lawsuit and the downgrade. S&P has said the downgrade was prompted by concern about Washington’s ability to manage the country’s debt.

In May of 1940, with tensions increasing in Europe and the German invasion of Poland, France and Germany prepared themselves for another Great War. The French had built the Maginot Line, a massive fortification of bunkers and artillery emplacements along the French German border and anticipated a long and bloody conflict, much like they fought in WWI.

It never came.

Instead, the Germans had developed what they called the “Blitzkrieg” and what we now know to be modern mechanized warfare. They had mobilized their infantry, bypassing the Maginot line and quickly caught the French flatfooted with an end-around through Belgium. The British Expeditionary Force was forced to retreat home with their tail between their legs, and the German won a stunning military victory.

The French lost their country, not necessarily due to poor planning or a lack of military reserves; they simply were not prepared to fight “tomorrow’s” war, because they were still fighting “yesterday’s war,” planning for a repeat of WWI. In fact, most huge military losses throughout the course of history, were due to the loser fighting a war that didn’t exist anymore; from Wallace’s loss at Falkirk to Russia’s loss in Afghanistan.

And now, ‘tomorrow’s war’ is upon us again.

This time it’s not being fought with guns or knives or even armed troops. The powers that be in this world are now raging a war in the financial markets and court systems in our nation’s backyards. It’s being fought for the same reasons most wars are fought — money and power — but it is foolish not to recognize it for what it is, a war.

There are very powerful people in this world, and they are much like the monarchs of old. They seek to expand their power, domain and influence. They are fighting the war with the pen and using the legal system and financial elements to establish dictatorial like powers over the masses, instead of using troops.

They are the George Soros’ of the world, and other people who we have not seen yet that are influencing the systems of the world to increase their stature. Like King Edward at Falkirk, they are using technology and fighting “tomorrow’s war” while we are left standing flat-footed expecting our carriers and tanks to protect us.

They can’t.

The power of an idea is one of the most deadly weapons you can use in a free society. They are using their money and influence to buy ideas in the marketplace, and then use them as weapons against what is standing in their way of them and their grab for power.

American freedom. Capitalism. Our Constitution.

All of them are under attack daily from these nefarious elements, in a war we had better get started fighting. They know that as long as people can do what they want, and when they want, they will never have full control of governments. They seek to destroy the will of the American people and their laws. They turn things upside down in an effort to tear down the idea that each of us is free to live a self-determined life, that all men are equal under the eyes of the law, and that we are all free to decide our own destinies.

Up is down. Black is white.

Every idea that could pose a threat to them is being systematically attacked and destroyed. They use the power of regulation to determine how and where our financial markets operate. They pack our court system with left leaning judges to circumvent the rule of law and the Constitution. They convince us that the world is doomed by the very act of acting freely — the green movement. By doing so, they increase their sway over our lives.

It’s time to fight back. Each individual must understand that this fight is not fought with guns, but with ideas. We need to start at the community level, in the same way our enemies did. Talk to our neighbors; make them understand the dangers of a government that would tell us how to live our lives. Write to our Congressmen and vote them out if they don’t start working to dismantle the machines of our enemies — the machine of big government.

Defending our Constitution has never become so important.

In November, America is probably facing the most important election since our Civil War. It will define us as a nation — do we stand for freedom of will and the Constitution, or do we surrender ourselves to the Philistines and allow them to direct our lives under the false idol of safety, security and protection? It’s not too late, just as it wasn’t too late when the British left at Dunkirk. Battles have been lost, but not the war, not yet.

Do we let the King come back to power to defend us, or do we pick up the pitchforks and defend ourselves, and — in turn, live our lives free from feudal rule?

It’s your decision.

Fight ‘tomorrow’s war’ in your neighborhood today, or we will end up tucking tail and running across the English channel and losing because we are still fighting “yesterday’s war.”

RICHMOND, VA –  Former Virginia Gov. Bob McDonnell and his wife have been indicted on federal corruption charges.

Peter Carr, a spokesman for the U.S. Justice Department, says McDonnell and his wife, Maureen, were indicted Tuesday on 14-counts including conspiracy, wire fraud and various other charges.

Gov. Bob McDonnell left office earlier this month after four years in the governor’s office, because Virginia law term-limits governors to a single term.

The long-going federal investigation loomed over the final months in office for this once-rising star of the Republican Party, with authorities looking into gifts he and his family received from a political donor.

In July, McDonnell apologized and said he had returned more than $120,000 in loans and other gifts from Johnnie Williams, the CEO of pharmaceutical company Star Scientific.

McDonnell enjoyed a large majority approval rating throughout his tenure in office, which only fell slightly during the year the investigation was made public. McDonnell won reelection in a landslide, and enjoyed monitory support far more than typical Republican candidates.

It is a sad day for the Republican Party.

Democrat Governor from New York Andrew Cuomo made controversial remarks toward conservatives on a radio interview with WCNY host Susan Arbetter.

Governor Cuomo, referring to the conservatives, stated, “Who are they? Are they these extreme conservatives, who are right to life, pro assault weapon, anti-gay, is that who they are? Because if that is who they are, and if they are the extreme conservatives, they have no place in the state of New York. Because that is not who New Yorkers are.”

Now Governor Cuomo’s office are in full crisis mode, trying to redirect the heavy fire they’ve received since that radio interview incredibly stating, “The governor did not say that.”

Cuomo’s office conveyed that the governor stated in the interview “it is fine” to oppose gun control measures, to be anti-abortion, and adding “he respects both positions.”

In the radio interview he went on a rant about conservatives,”You have the Republican Party searching for identity; they are searching to define their soul. That is what is going on. It is the Republican Party that is it a moderate party or is it a conservative party? Their problem is not me and democrats, their problem is themselves.”

According to Cuomo’s office his remarks have been taken out of context.

The governor didn’t seem to understand that the Republican Party, unlike the Democratic Party, emphasizes individual thought based upon a set of principles. Unlike the monolithic-thinking Democratic Party, conservatives view party politics much like a marriage. That is, if there are no arguments or disagreement within a marriage, then there is something wrong with that marriage.

Cuomo, who has aspirations of running for President, particularly if Hillary Clinton does not, is finding himself alone in his defense. Not a single liberal wouldn’t denounce the governor’s comments as pure intolerance. However, as was the case with Phil Robertson just weeks ago, it would appear that progressivism, in practice, is just that.

This is starting to sound a bit more like the biggest mass fraud ever perpetuated on the American people, rather than your typical expected behavior from a politician. It is evident from testimony and various experts’ statements, the depth to the healthcare.gov security problems is such that no Americans’ user information is secure.

David Kennedy, a white hat hacker who testified at the House Science, Space, and Technology Committee hearing in Nov. and again in Jan., told Chris Wallace the healthcare.gov security system was actually “worse off” today than when he first analyzed the site after launch.

David Kennedy, in response to the government’s claim that they haven’t detected any successful hacks, said the government was being deeply disingenuous:

 There’s November testimony by Congress that basically said that a third party company was contracted to build out what we call the security operations center, which is what would actually detect these types of attacks. As of November, it hadn’t even been started yet. So, if you look at how long these security operations centers take to put into play, it takes several months, if not years to actually implement and fully build the attacks out there. So, as of November we have no modern detection. And that, from my understanding, it’s still not happening to this date. So they’re accurate in their statement. They haven’t detected any attacks on the website, because they don’t have the capability to detect them.

Chris Wallace asked if the government had contacted him to request his help in fixing the healthcare.gov security problems, David Kennedy said no, but that he would do it for free if they did.
